5. Data Retention
Contact form submissions are retained for 24 months. Contract-related data is retained for 10 years as required by German tax law (AO §147). Server logs are automatically deleted after 30 days.

1. Scope
These Terms of Service govern all services provided by VisualGrowthWorks, Zeppelinstr. 38, 14471 Potsdam, Germany ("Provider") to clients ("Client"). By engaging our services, the Client agrees to these terms.

2. Service Delivery
VisualGrowthWorks provides web design, visual design, conversion rate optimization, and related digital services as specified in individual project proposals. All deliverables, timelines, and pricing are defined in the signed project proposal or statement of work.

3. Payment Terms
Invoices are due within 14 days of issuance unless otherwise agreed. Late payments incur a statutory interest rate of 9 percentage points above the ECB base rate. All prices are in EUR and exclusive of VAT unless stated otherwise.

4. Intellectual Property
Upon full payment, all final deliverables and associated intellectual property rights transfer to the Client. VisualGrowthWorks retains the right to display completed work in its portfolio and marketing materials unless explicitly declined in writing.

5. Revisions
Each project includes two (2) rounds of revisions as standard. Additional revision rounds are billed at €75/hour. Revisions requested after final approval are treated as new work items subject to a separate proposal.

6. Limitation of Liability
VisualGrowthWorks liability is limited to the total project value. We are not liable for indirect damages, lost profits, or consequential losses. This limitation does not apply to cases of gross negligence or willful misconduct.

7. Confidentiality
Both parties agree to treat confidential information received during the engagement as strictly confidential. This obligation survives the termination of the agreement for a period of 24 months.

8. Governing Law
These terms are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is Potsdam, Germany.

1. Cancellation Before Project Start
If a project is cancelled before work has commenced, 100% of any advance payment is refunded within 14 business days. No cancellation fee applies if terminated within 48 hours of project confirmation.

2. Cancellation During Project
If a project is cancelled after work has commenced, the Client is invoiced for all work completed up to the cancellation date, calculated as a percentage of the total project value based on project milestones achieved. Any overpayment is refunded within 14 business days.

3. Deliverable Disputes
If the Client is dissatisfied with delivered work, VisualGrowthWorks will perform up to two (2) additional revision rounds at no charge. If the Client remains unsatisfied after revisions, a partial refund proportional to the undelivered scope will be issued within 14 business days.

4. Retainer Cancellation
Monthly retainer agreements may be cancelled with 30 days written notice. No refund is issued for the current billing period. Annual retainer agreements may be cancelled with 60 days written notice, and a prorated refund for unused months is issued.

5. Refund Method
All refunds are processed via the original payment method. Processing time is 5–14 business days depending on the payment provider. The Client will receive email confirmation once the refund is initiated.
